Terms & Conditions of Sale

These terms and conditions govern the sale of Products (“Product or Products”) and provisions of Services (“Services”) by Kurious Lab LLC DBA Let's Start Coding (‘Let's Start Coding’) and its affiliates as well as by third party vendors and/or service providers of Let's Start Coding. Services are defined as any service and/or content Let's Start Coding makes available to or performs for Customer, as well as materials displayed, transmitted or performed on the website (www.LetsStartCoding.com). These terms and conditions (“Agreement”) take precedence over Customer’s supplemental or conflicting terms and conditions to which notice of objection is hereby given. Neither Let's Start Coding’s commencement of performance or delivery shall be deemed or construed as acceptance of Customer’s supplemental or conflicting terms and conditions. Let's Start Coding’s failure to object to conflicting or additional terms will not change or add to the terms of this agreement. Customer’s acceptance of the Products and/or Services from Let's Start Coding shall be deemed to constitute acceptance of the terms and conditions contained herein. These terms are subject to change and may be revised at any time. All revisions will be effective upon Let's Start Coding posting updated terms to its website.

Limitation of Liability

Let's Start Coding's liability to Customer is limited to Customer’s direct damages up to an amount not exceeding the price of the Product at issue. Let's Start Coding is not liable for, and Customer is not entitled to any indirect, special, incidental or consequential damages of any kind arising in any way out of use of Products, including, without limitation, loss of profits or revenue, loss of data, loss of use, rework, repair, manufacturing expense, costs of product recall, property damage, lost data, personal injury, death, legal expenses, injury to reputation or loss of customers. To the extent Let's Start Coding cannot lawfully disclaim any implied or statutory warranties, Customer’s statutory rights are not affected by this limitation of liability. Customer will indemnify, defend and hold Let's Start Coding harmless from any claims based on (a) Customer’s compliance with Let's Start Coding's designs, specifications, or instructions, (b) modifications of any products by anyone other than Let's Start Coding, or (c) use in combination with other products.

Safety

Your safety is your own responsibility, including proper use of equipment and safety gear, and determining whether you have adequate skill and experience to use Products. Electricity and other resources used with Products can be dangerous unless used properly and with adequate precautions, including safety gear. Some illustrative photos and instructional content do not depict safety precautions or equipment. Use of instructions, kits, and projects is at your own risk. Let's Start Coding disclaims all responsibility for any resulting damage, injury, or expense. It is your responsibility to make sure that your activities comply with applicable laws. If you feel uncomfortable with assembling any project or kit, simply contact us to return it for a full refund.

PARTIAL INVALIDITY

If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will nevertheless continue in full force without being impaired or invalidated in any way.
